Employment Lawyer Thailand — Unfair Dismissal, Severance & Labour Court

Labour disputes run on short deadlines through specific channels: a complaint to the labour inspector or a claim in the Labour Court. We act for dismissed employees and for employers building compliant systems under the Labour Protection Act to reduce future disputes.

Work we accept

  • Unfair dismissal, severance pay, notice pay and special severance
  • Unpaid wages, overtime, holiday pay and annual leave
  • Complaints to the labour inspector and appeals of orders to the Labour Court
  • Claims and defences in the Labour Court, for employees and employers
  • Drafting employment contracts, work rules and warning letters that hold up in law
  • Mutual separation agreements and enforceable restrictive covenants
  • Foreign-employee issues linked to work permits and visas
  • Work injuries, the Workmen's Compensation Fund and social security coordination

What we do not do

  • Back-dating documents to suggest warnings or consent that did not occur
  • Guarantees of the amount recoverable or the outcome of an inspector's order
  • Work requiring an auditor's signature, such as certifying the employer's financial statements

Documents to prepare

  • Employment contract, work rules and employee handbook
  • Payslips, transfer records and time records
  • Termination letter, warning letters or investigation minutes
  • Messages or e-mail relating to the dismissal or instructions given
  • Social security papers, and compensation fund papers for work injuries
  • Work permit and visa documents for foreign employees

How the matter proceeds

  1. 1.Rights and deadline check

We compute service length, severance entitlement under the Labour Protection Act and the filing deadlines, which in labour matters are often shorter than expected.

  2. 2.Choosing the route: inspector or Labour Court

We compare a labour-inspector complaint, which is fee-free and focused on wages and severance, with a Labour Court claim, which can also cover unfair-dismissal damages.

  3. 3.Negotiation or conciliation

We present the claim with a verifiable calculation and attend Labour Court conciliation, where many labour cases end.

  4. 4.Hearings in the Labour Court

We present evidence on the grounds for dismissal, proportionality of discipline and compliance with internal procedure; Labour Court procedure is flexible and equity-focused.

  5. 5.Enforcement and system remediation

We pursue payment under the judgment and, for employers, revise work rules, warning templates and investigation procedure to prevent repeat disputes.

Courts and authorities involved

  • Central Labour Court and Regional Labour Courts 1 to 9 by workplace location
  • Provincial or area Labour Protection and Welfare Offices for inspector complaints
  • Social Security Office and Workmen's Compensation Fund for benefits and work injuries

Before you decide

  • Signing a resignation or a receipt-and-release may bar a severance claim — have counsel read it first.
  • Warning letters that do not state the conduct and the rule breached rarely support dismissal without severance.
  • Labour filing deadlines are short; delay costs rights.
  • Foreign employees must consider the effect on work permit and visa alongside the claim.

Frequently asked questions

How much severance applies on dismissal?

The Labour Protection Act sets severance by length of service in bands that rise with seniority. We calculate from your actual service and final wage, plus notice pay and unfair-dismissal damages where grounds exist.

Is dismissal for poor performance unfair?

Not automatically. The court examines whether the reason is real, whether notice and a chance to improve were given under internal procedure, and whether dismissal was proportionate.

Inspector complaint or Labour Court claim?

The inspector route is fee-free and suits clearly calculable wages and severance; the Labour Court suits unfair-dismissal damages or disputed facts needing evidence. We choose the route that preserves the most rights.

What should an employer prepare to reduce risk?

Published work rules, contracts consistent with them, time records, warning templates that state the conduct and rule breached, and an investigation step before discipline. We review and revise all of these.

Do foreign employees have the same rights?

Labour protection applies to employees working in Thailand regardless of nationality, but dismissal affects the work permit and stay, so both must be planned together.

What should be done after a work injury?

Notify the employer and claim through the Workmen's Compensation Fund, keeping medical certificates and evidence. A refusal or under-assessment can be appealed and litigated.

Are post-employment non-competes enforceable?

Only so far as scope, duration and territory are reasonable and do not unduly bar earning a living; overly broad clauses may be reduced or refused.

How are employment case fees calculated?

Quoted in writing before work starts, based on the route and the volume of documents. Inspector complaints carry no government fee, and employees' Labour Court claims are exempt from court fees by law.
