Criminal Defence Lawyer Thailand — Police Stage to Trial, Bail & Suspect Rights
Criminal matters affect liberty directly, and the investigation stage matters most because statements given there follow the file to trial. We attend police questioning, apply for provisional release, and represent clients at trial — acting for suspects and for injured parties pursuing a case.
Work we accept
- Attending police questioning and advising before any statement is given
- Bail applications at the investigation, detention, trial and appeal stages
- Economic crime: fraud, embezzlement, cheque offences and Computer Crime Act matters
- Criminal defamation, including parallel civil damages claims
- Traffic accident cases with criminal charges, and settlement talks with injured parties
- Filing complaints and acting as joint prosecutor for injured parties
- Assistance for foreign nationals, with interpreters and certified translations
What we do not do
- Any promise that you will not be charged, detained or that a case will be dismissed
- Approaching officials for any improper outcome
- Providing bail security out of the firm's own funds
Documents to prepare
- Any summons, arrest warrant or arrest record received
- ID card or passport, plus immigration documents for foreign nationals
- Documents relating to the allegation: contracts, transfers, chat records
- Security for bail: title deed, bank book or deposit certificate
- Names and contact details of witnesses
- Medical certificate or proof of loss where you are the injured party
How the matter proceeds
1.Urgent intake and charge assessment
The attorney reviews the warrant and alleged facts, identifies the possible charges and penalties, and explains suspect rights under the Criminal Procedure Code.
2.Attending the police interview with counsel
A suspect has the right to counsel present during questioning. We prepare the position, check the record before signing, and object to improper questioning.
3.Bail application and security
We prepare the release application, arrange security to meet the court's or investigator's criteria, and appeal a refusal where grounds exist.
4.Prosecution stage and trial
Where grounds exist we petition the public prosecutor, then file the defence, present rebuttal evidence and follow the strategy agreed with the client.
5.Judgment, appeal and remedies
We explain the judgment and any conditions imposed, assess appeal grounds within the statutory period, and address compensation or restoration of rights.
Courts and authorities involved
- Criminal Court and the Bangkok South, Phra Khanong, Min Buri and Taling Chan Criminal Courts
- District (Kwaeng) courts for lower-penalty offences and provincial courts where the offence occurred
- Criminal Court for Corruption and Misconduct Cases for matters within its exclusive jurisdiction
Before you decide
- Do not give a statement or sign anything before advice; investigation statements can be used against you at trial.
- Negotiating compensation yourself may be read as admitting facts — do it through counsel.
- A suspect has the right to consult counsel privately and to an interpreter if Thai is not understood.
- Appeal deadlines are short and strictly applied; a missed deadline is very hard to cure.
Frequently asked questions
What should I do if I receive a summons?
Contact a lawyer before the appointment and do not ignore it, as an arrest warrant may follow. We coordinate the attendance date, prepare documents and attend the interview with you.
How much security is needed for bail?
The court or investigator sets it according to the charge and circumstances, so there is no fixed figure. We check the criteria applied in your case and prepare the security before filing.
What if bail is refused?
A fresh application with further grounds and security can be filed, or the refusal can be appealed to a higher court within the prescribed period; we act immediately on receiving the order.
What extra preparation applies to foreign nationals?
An interpreter is needed for questioning and in court, foreign documents need certified translation, and some need notarisation and legalisation first — we handle all three in one place.
Can an injured party pursue the case?
Yes — by complaint to the investigator or by filing directly, and you may join the prosecutor as co-plaintiff and claim compensation within the criminal case.
Can a criminal case be settled?
Compoundable offences such as defamation and some fraud can be settled by law, while offences against the state cannot — the distinction must be clear before any agreement.
Can the lawyer really sit in on questioning?
Yes. The Criminal Procedure Code gives a suspect the right to have counsel or a trusted person present during questioning; the right should always be used.
How are criminal defence fees calculated?
We assess the charge, the stage and the volume of evidence, then quote in writing before starting. Court fees and travel costs are separate items, never billed without prior notice.
