Civil Litigation Lawyer Thailand — Contract, Debt, Property & Lease Disputes

A civil case is a private dispute asking the court to order payment, delivery, compensation or performance of a contract. The office handles the matter from case assessment and demand letter through filing, evidence hearings and enforcement. The attorney of record signs the pleadings and appears in court personally.

  • Title deed, lease or right-of-possession documents for land and lease cases
  • Power of attorney where the signatory is not the authorised representative
  • Foreign documents with certified translation, and notarisation where required

How the matter proceeds

  1. 1.Case and limitation assessment

    The attorney reviews the documents, identifies the cause of action, the applicable limitation period and the competent court, and points out gaps in the evidence.

  2. 2.Demand letter and negotiation

    A properly formed demand or termination notice is issued. Many matters resolve at this stage, and the notice remains key evidence if filing follows.

  3. 3.Filing the claim or defence

    The complaint or defence is drafted, court fees are computed on the claim value under the schedule to the Civil Procedure Code, and the case is filed with the competent court.

  4. 4.Mediation, issue settlement and hearings

    We attend court mediation, settle the issues in dispute, file the list of witnesses and conduct the hearings; the attorney of record appears personally.

  5. 5.Judgment, appeal and enforcement

    We explain the judgment, assess appeal grounds within the statutory period, and pursue execution, asset tracing and attachment if the debtor does not comply.

  • Civil Court and the Bangkok South, Phra Khanong, Min Buri and Taling Chan Civil Courts
  • Provincial and district (Kwaeng) courts where the defendant is domiciled or the property is located
  • Central Intellectual Property and International Trade Court for cross-border trade disputes

Before you decide

  • Limitation periods differ by cause of action; delay can bar the claim entirely — have it checked first.
  • Court fees are calculated on the amount claimed, are not a flat figure, and are separate from attorney fees.
  • Chat and e-mail messages cut both ways as evidence; do not delete them and do not acknowledge a debt before advice.
  • Winning is not the same as being paid. If the debtor holds no assets, asset tracing must be planned from the start.

Frequently asked questions

How are civil litigation fees calculated?

How long do I have to file?

It depends on the cause of action. General claims under the Civil and Commercial Code run for ten years, while tort and wage claims are much shorter, so the start date must be checked for your specific matter.

Must I attend every hearing?

You must testify in person at hearings where you are a witness. For other appearances, such as case-management hearings, the attorney can attend on your behalf.

Can I sue a party living abroad?

Yes, where a Thai court has jurisdiction — for example the cause arose in Thailand or the asset is here. Service abroad takes longer, and foreign documents need certified translation, which we handle in-house.

Is mediation better than filing?

Often it costs less time and money and still produces an enforceable agreement. We compare the options first, but if the other side does not cooperate, filing may be the only way to preserve your rights.

Can I sue on a verbal agreement?

Some contracts are valid without writing, but proof is harder. We gather supporting evidence — transfers, chat records, witnesses — and assess its strength before recommending that you file.

How long will the case take?

It depends on the court, the volume of evidence and any appeal, so no fixed period can be promised. We report the timetable from the court's actual hearing dates at each stage.

Do documents need certification before use in court?

Documents executed abroad and foreign powers of attorney usually need notarisation and consular or embassy legalisation first. We provide both the litigation and the certification work in one place.
